USHER'S ex-wife weeps as a judge denies her custody of their two children.
Tameka Foster Raymond filed for temporary custody after the couple's five-year-old son nearly drowned in the singer's pool.
But a judge refused to honour the request on Friday, saying he wasn't certain the accident was preventable.

Tameka, who was dressed in a white suit for the hearing in Atlanta, sobbed as the ruling was read out.

Last week their son Usher Raymond V had to be rushed to hospital after getting his hand caught in the pool drainage system.

He is thought to have got into trouble when he went after one of his toys that had been sucked into the drain.
The boy, who was in the care of Usher's aunt at the time, is recovering well in hospital.
This morning Tameka tweeted: "I feel great this morning! My son and I got a good night's sleep. Didn't even hear the nurses fumbling around. Yaaay, I usually sleep so light."

Judge John J. Goger advised Usher to keep his ex-wife well advised of his whereabouts and who’s taking care of the children.

Usher and Tameka Raymond married in 2007 and divorced two years later.
The singer was awarded primary custody of the boys last year following a lengthy custody battle
