Germany's Freenet files for court injunction against 5G auction rules

BERLIN, March 12 (Xinhua) -- The German telecommunications company Freenet has filed an appeal for an injunction against the 5G auction rules set by the German federal network agency (BNetzA), a company spokesperson confirmed on Tuesday.

"We are preserving our interests through this legal remedy," said Nadine Mette, spokeswoman for Freenet.

It would be important to "make oneself heard," since Germany's three largest mobile network operators -- Deutsche Telekom, Vodafone and Telefonica -- are also appealing BNetzA's auction rules for 5G frequencies, Mette told Xinhua on Tuesday.

The three largest network operators had also filed injunctions as they fear that the high investment costs would not make 5G technology profitable in the future.

The BNetzA obliges network operators to guarantee a nationwide expansion of their 5G networks when buying the frequencies and, in certain cases, they would also have to share their own network with competitors.

Freenet, which does not operate its own network, is concerned that Telekom, Vodafone and Telefonica could deny it access to their 5G networks.

Freenet therefore wants BNetzA to make access to these networks mandatory. Such an obligation would be "necessary and possible," stressed Mette.

BNetzA is scheduled to start the auction of frequencies for 5G mobile services next Tuesday. Despite the injunction filed by Freenet, the company does "not think that there will be a delay in the auction," said Mette.
