BEIJING, May 28 (Xinhua) -- China has just adopted its Civil Code. The law governs almost all civil activities of an individual -- from birth to death, from life to work. Its 84 chapters, and 1,260 articles are closely related to the lives of everyone that lives in China.
The Civil Code stipulates that all natural persons are equal as regards their capacity for civil rights.
Even unborn children are entitled to the rights of inheritance and gifts.
Minors who are victims of sexual abuse or assault can still claim their rights through legal channels when they reach 18.
The Civil Code also clarifies that Party and government departments, enterprises, schools, and other institutions should adopt appropriate measures to prevent and stop sexual harassment that takes advantage of power or position.
According to the code, the property rights of the State, collective, and individuals are all equally protected.
Data and online virtual assets are also legally protected.
The code bans usury, stating that loan interest rates shall not violate national regulations.
The law explicitly safeguards every Chinese person's personality rights and other rights and interests based on personal freedom and dignity.
In the code, the concept of privacy is more clearly defined. The scope of protected personal information has been expanded to include email addresses and location data.
The law prohibits the purchase or sale of human cells, tissues, organs, or remains in any form.
In marriage and family relations, both husband and wife shall enjoy equal status, and should be faithful to, respect and care for each other.
Families shall also establish ethical family principles and maintain integrity.
In addition, the Civil Code specifies the scope of marital property and debts.
Regarding environmental damage, the code stipulates that those who harm others due to pollution or ecological destruction shall bear tort liability.
In the course of compiling the Civil Code, more than 1.02 million opinions and suggestions were submitted by 425,000 people.
The code responds to public concerns and suits the current economic and social climate. Outdated provisions have been revised and improved, and new clauses added.
The Civil Code could be seen as "an encyclopedia for society" and it also lays down fundamental principles for the market economy.
It emphasizes equality and protection.
The articles in the Civil Code reflect the spirit and values of the Chinese nation.
The code will help with the implementation of rule of law, provide more robust legal support for people's rights and interests, and improve public welfare.■
